This Acceptable Use Policy ("AUP") governs your use of the services provided by Resonate Mail OÜ ("Resonate Mail", "we", "us", "our"), including Resonate Reach and Resonate Amplify. This policy is incorporated into and forms part of our Terms of Service.
By using our Services, you agree to comply with this AUP. Violation of this policy may result in immediate suspension or termination of your account without notice.
1. General principles
Resonate Mail is built for legitimate email marketing and communication. We expect all users to send emails responsibly, respect their subscribers, and comply with all applicable laws. Our platform's reputation — and yours — depends on it.
2. Prohibited content
You may not use our Services to send, store, or distribute content that:
- Is unsolicited or spam. You must have the recipient's prior consent or another lawful basis (such as an existing business relationship) before sending any marketing email. Purchased, rented, scraped, harvested, or third-party lists are strictly prohibited.
- Is deceptive or misleading. Emails must not contain false or misleading sender information, subject lines, or content. You must accurately identify yourself as the sender.
- Is illegal. Content that violates any applicable law or regulation, including content that promotes illegal activities, substances, or services.
- Infringes intellectual property rights. Content that infringes the copyright, trademark, or other intellectual property rights of any third party.
- Is harmful, abusive, or harassing. Content that threatens, harasses, defames, or discriminates against any individual or group.
- Contains malware or phishing. Content designed to deceive recipients into revealing personal information, or that contains viruses, trojans, or other malicious software.
- Promotes violence or hatred. Content that incites violence, hatred, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
- Contains adult or sexually explicit material, unless the sender operates a lawful adult business and all recipients have explicitly opted in to receive such content.
- Relates to prohibited industries. This includes, but is not limited to, content related to illegal gambling, counterfeit goods, unlicensed pharmaceuticals, pyramid schemes, multi-level marketing recruitment, and cryptocurrency pump-and-dump schemes.
3. Sending requirements
When using Resonate Reach, you must comply with the following requirements:
3.1 Consent
You must only send emails to recipients who have given you clear, informed consent to receive your emails, or where you have another lawful basis under the GDPR and applicable anti-spam legislation (such as the CAN-SPAM Act, CASL, or the EU ePrivacy Directive).
3.2 Identification
Every email you send must clearly identify you (or your business) as the sender. You must include your legal business name or trading name and a valid physical postal address.
3.3 Unsubscribe mechanism
Every marketing email must include a clear and functioning unsubscribe link. Unsubscribe requests must be honoured within 48 hours. You may not require the recipient to log in or take additional steps beyond clicking the unsubscribe link.
3.4 List hygiene
You are responsible for maintaining clean subscriber lists. This includes promptly removing hard bounces, unsubscribes, and complaint addresses. Repeatedly sending to invalid addresses or generating excessive complaint rates may result in account suspension.
3.5 Bounce and complaint thresholds
We monitor bounce rates and spam complaint rates across the platform. If your campaigns consistently exceed the following thresholds, we may require corrective action or suspend your sending privileges:
- Hard bounce rate: Above 5% per campaign
- Spam complaint rate: Above 0.1% per campaign
4. Prohibited use of the platform
You may not use the Services to:
- Attempt to gain unauthorised access to our systems, other users' accounts, or any network or server connected to the Services.
- Interfere with or disrupt the integrity or performance of the Services.
- Reverse-engineer, decompile, or disassemble any part of the Services.
- Use the Services to send emails on behalf of a third party without their authorisation.
- Resell, sublicense, or redistribute access to the Services without our prior written consent.
- Use automated tools (bots, scrapers) to access the Services in a manner that exceeds normal usage or places an unreasonable load on our infrastructure.
- Circumvent or attempt to circumvent any security measures, rate limits, or access controls.
5. Monitoring and enforcement
5.1. We reserve the right to monitor usage of the Services to ensure compliance with this AUP. We may review Content and campaign data for this purpose.
5.2. If we determine that you have violated this AUP, we may take any of the following actions at our sole discretion:
- Issue a warning and request that you remedy the violation.
- Temporarily suspend your sending privileges or account access.
- Permanently terminate your account.
- Remove or disable access to prohibited Content.
- Report the violation to law enforcement or relevant authorities.
5.3. We will make reasonable efforts to notify you before taking enforcement action, except where the violation poses an immediate risk to our platform, our other users, or third parties.
6. Reporting violations
If you believe that a Resonate Mail user is violating this AUP, please report it to us at [abuse@resonatemail.com]. We take all reports seriously and will investigate promptly.
7. Changes to this policy
We may update this AUP from time to time. Changes will be posted on our website and, where material, communicated to users in advance. Continued use of the Services after changes take effect constitutes acceptance of the revised policy.
